How to Stop Kids Throwing Rocks at Dog, Faifax VA?

Question by Gonzo: How to stop kids throwing rocks at dog, Faifax VA?
2 kids approximately 7-10 years old have been coming onto my property to throw rocks and sticks at my dog, which traumatizes her. I yelled at them once and they were back 10 minutes later doing it again. I yelled at them again, and they laughed and walked off. I then filed a police report, and the animal control officer informed me the only recourse I had to was find out where they lived by following them home. He acknowledged I might be in trouble myself if I am caught doing this. If I find out where they live he said he could go and have a talk with the parents, and this would resolve the issue. However to me this sounds like I am setting myself up for further retaliation and months of paranoia over watching my dog. He also suggested I build a fence inside of my current fence to keep the kids further from the dog. None of these are acceptable solutions to me, I am currently researching if there are any other non-passive steps I can take to ensure my dog is no longer tortured by these delinquents. I cannot believe that trespassing and animal cruelty is something I cannot defend my dog against in my own yard.

Can anybody point me to any laws in Fairfax Virginia that will enable me to protect my dog? Or to other laws around the country that I could try to get passed into legislation here, there are many other dog owners in my neighborhood and we would all be interested in this. I am not trying to find an excuse to shoot or physically assault them, I am trying to find laws that will enable me to prosecute them or detain them. Or if anybody has any experience with this and has a non-law enforcement solution less costly than building a second fence, which would diminish my dogs quality of life as well. I am only interested if anybody can provide me links to primary sources outlining the laws, not hearsay. Thank you very much.

Follow the little brats home the next time you see them. As a parent I would want to know if my kids were acting this way so I could deal with it. You never know…the parents may be a huge help to solve this situation. If you don’t deal with it they will always do this to animals and assume it is acceptable but it isn’t. Good luck!

Throwing rocks at your dogs is ANIMAL ABUSE and it’s illegal – in fact….. in Virginia – it’s a Class 1 Misdemeanor. Skip your lazy humane officer and call the police.

Here are the dog laws for Virgina:http://www.animallaw.info/statutes/stusvast3_1_796_122_126.htm

Quote: Any person who: (i) overrides, overdrives, overloads, tortures, ill-treats, abandons, willfully inflicts inhumane injury or pain not connected with bona fide scientific or medical experimentation, or cruelly or unnecessarily beats, maims, mutilates, or kills any animal, whether belonging to himself or another; (ii) deprives any animal of necessary food, drink, shelter or emergency veterinary treatment; (iii) sores any equine for any purpose or administers drugs or medications to alter or mask such soring for the purpose of sale, show, or exhibition of any kind, unless such administration of drugs or medications is within the context of a veterinary client-patient relationship and solely for therapeutic purposes; (iv) willfully sets on foot, instigates, engages in, or in any way furthers any act of cruelty to any animal; (v) carries or causes to be carried by any vehicle, vessel or otherwise any animal in a cruel, brutal, or inhumane manner, so as to produce torture or unnecessary suffering; or (vi) causes any of the above things, or being the owner of such animal permits such acts to be done by another is guilty of a Class 1 misdemeanor.

I like what NewfieMom had to say. Now you just need to find a way to identify the kids. Is there any way that you could film them throwing the rocks and have a neighbor’s kid identify them?
