Question by CatEye: How can they keep giving themselves a raise just because i am now divorced and not a family member?
I’m not at this time looking at a lawyer but just want to maybe get a bit of advice from you professionals or the like before I decide to do something down the road. I just don’t have the money for a lawyer at this time and feel so vulnerable.
I will try to keep this simple
Has anyone ever been in this situation?
I am a partner in a family owned business.
I recently divorced and they are now treating me as an outsider. I am no longer a part of their family due to the divorce of their daughter.
The active members (the other two kids) whom run the day to day business own the same percent as I do. One is the in-law and the other the only son. I have worked the day to day business and have been in the business the longest of the current active company partners and feel I have had a lot to do with its success.
The presidents of the company were the mom and dad. The dad whom died and the Mom has thermal brain cancer and a short time to live. The Dad was the head of the business owning a large percentage but less than 50% of the active and non active partners & spouses. (Kids). The son has power of attorney now for the Mom that has brain cancer. The living mother never was into the business details or knew what really goes on at the office.
All the (kids) members of the business outside of the father & mother, had or has an equal share of business ownership. 3 of us 5 partners have always received the same salary to keep things fair. The non active members (spouses) were not receiving a salary, but would get small partner distributions. The Dad took a salary as the general, but has died but still receives his salary.
The partnership agreement sais (for the kids part) we are all required to work a fair amount of hours, or what is prudent, but nothing is stated on our partner agreement about salary or increases in salary or cost of living etc.
Being I am divorced now for three years and not a family member but still one of the three active members and equal owners by percent, I feel I have been treated unfairly. I have since been ignored to be invited to decision making meetings for the company. I have been excluded from one partner distribution that I know of, and have not had a raise as the other have and very health ones at that.
I guess and feel they can make what they want without telling me. I just happened across all this. What keeps them from making 2 times what I make or more? There is no agreement on salary guidelines, where is the limit?
They have also spent thousands of dollars; some of mine of the main profit pot on family lawyer fee’s and probably have paid the lawyer to see what they can do to get me out of the partnership.
What a life, I have spent so much effort in looking out for this company, as the son, a past drug abuser would not stay at work. He is the son with the power of attorney. I think they will just keep giving themselves more and hope I will get frustrated and go away or sell out. I don’t really want to sell out but it is hard to take the abuse and more then I have described here. I would have to write a book about their schemes to try to get rid of me. I live in Virginia beach by the way.
So what do you think? Do I even have a right on them taking a salary increase that I feel is partly from mine and the others money in the company expense pot?
