Question by traci S: What happens if you are charged with a felony while on probation?
My son is a drug addict. He was charged earlier in the year on 2 felonies, but they were reduced to misdemeanors and he was given probation. He was recently arrested on burglary charges. Will he finally go to prison? We live in Alabama.

yes. probation means if you screw up again its automatic jail time.

My only sourse is the fox show cops…and everytime they arrest somebody who’s already on probabtion they tell them their going to jail…

Depends on the burglary charges and how serious they are. It also depends on what was taken and the amount. But I would imagine that if he’s on probation, he’s revoked it by getting into trouble again.
I’m so sorry. That must be really hard on you. He needs serious help for his addiction. I think he needs rehab more than prison. Have you discussed maybe an intervention for the family and friends?
If convicted he will face the full sentence of the previous offense plus whatever they add on for the latest offense.

it depends on your lawyer and how much money you have. you can bargain it down and just pay a large fine and a bunch of community service but if you can afford a great lawyer then ya he will probably go to prison for a while.
Ouch. I’m sure your son means well. It’s too bad he is in the mess he is in down there. I wish you and him nothing but the best of luck. I would guess he will be sentenced to 3 to 5 years. If he has a great lawyer, then maybe 2. Anything less is a good ol boy hookup.

No seriously though… It is a great possibility that he will go to jail for violation of his probation in which I am sure one of the requirements was to not get in anymore trouble… Sole decision is left up to the judge though!

I fear that your son may have to go to jail.
I had problems with drugs through high school and college…. though I didn’t really think of it as a “problem” at the time. Now at 26, when I look back, even though I have finished college, received two bachelor of science degrees, I could have done so much more if I would have cut out the time I spent with the “wrong group of people.”
I sympathize with you, and wish you and your son the best — but I don’t think he is going to make any changes in his life until he really hits bottom. Some people have to hit bottom before they want to make a personal change.
I still would LIKE to use drugs… I think once you have put yourself in a drug-friendly environment for a period of time, you will never forget the pleasure that comes with use), but I am trying very hard and have stayed away for months now. Hopefully he will reach a “level of maturity” (I don’t know what else to call it) when you realize that “I have to stay away from doing these things if I want to get anything truly good out of life.”
More than likely he will go to jail — it depends on the terms of his probation and since he has repeated a serious crime, maybe he hasn’t learned his lesson yet.
I’m sorry for your situation, and hope something good comes out of it.
he will go to jail, he violated his probation. probations are not meant to be violated.
